Over the years we have found that the Uncontested Divorce is the most efficient method to obtain a divorce. However, we understand that in some situations the marriage is so fractured that it is impossible to communicate with your spouse to reach an agreement in which case a Contested Divorce must be filed. In the Contested Divorce the case proceeds just like many other civil lawsuits. A divorce complaint is filed with the court and the other spouse is served with the divorce complaint, usually by the Sheriff, and they have 30 days to respond. Typically, the other party will hire a lawyer and the litigation begins. Written discovery is sometimes requested and in some cases depositions are scheduled. Many Judges now require the parties to attend mediation before the final hearing will be scheduled. The Contested Divorce process can take many months to litigate to a final decree.
